 NOTICE OF SUBSTITUTE TRUSTEE’S FORECLOSURE SALE
    WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of
Trust dated August 30, 2001 executed by Arthur L. Crisp, (“Borrower”)of record in Book 561, page 238 Register’s
Office for Hardeman County, Tennessee (“ROHCT”) (“Deed of Trust”), wherein certain real property was conveyed
to Hornsby Law Firm, Trustee as collateral; and,
    Whereas the beneficial interest of said Deed of Trust was last transferred and assigned to HLM Holdings,
LLC, (“Lender”) whose address is 5115 Maryland Way, Brentwood, Tennessee, 37027 who is the owner and holder
of the debt; and
    WHEREAS, by an Appointment of Substitute Trustee of record in Book 725, page 882 in the ROHCT, Lender has
appointed Rebecca T. Garland of Davidson County, Tennessee as Substitute Trustee.
    NOW, THEREFORE, Rebecca T. Garland, Substitute Trustee, hereby gives notice that at 1:00 p.m. on Thursday,
August 6, 2015, at the west entrance of the Hardeman County Courthouse, Bolivar, Tennessee, the Substitute Trustee shall proceed to sell the Property at public outcry to the highest and best bidder for cash, in bar of Borrower’s legal and equitable rights of redemption, statutory or otherwise, and any homestead, marital or elective share rights, and all other similar rights or exemptions arising under or created by any applicable statute or judicial decision, all of which were expressly waived .
    The Property to be sold is more fully described as follows: Being Lot No. 11 of Hannis Subdivision. Beginning at
a stake on West side of Hannis Street, the Southeast corner of Lot No. 10, runs thence North 59 degrees West 600 feet with south line of said Lot 10; thence South 36 degrees 30 minutes East 408 feet with north line of Lot No. 28; thence South 69 degrees East 260.5 feet with north line of Lot 12 to margin of Hannis Street; thence with Hannis Street North 21 degrees East 110 feet to point of beginning, containing .86 acres and Being Lot No. 12 of Hannis Subdivision. Beginning at a stake on west side of Hannis Street, the Southeast corner of Lot No. 11, runs thence North 69 degrees West 260.5 feet with south line of said Lot 11; thence South 36 degrees 30 minutes East 263.5 feet with north line of Lot No. 28; thence North 79 degrees East 60.7 feet with north margin of Oak Hill Church Road; thence with North 15 degrees East 110 feet with west margin of Hannis Street to point of beginning, containing .6 acres, included in this description is a 10 foot wide strip or easement along the west side of this lot herein described..

    Tax I.D. Map 99, Parcels 6.09 and 6.10. Subject to taxes due for Tax Year 2015 not yet due..
    The street address is believed to be 1200 Oak Hill Road, Bolivar, Tennessee 38008. In the event of any conflict or
ambiguity the aforesaid description of the Property shall control.
    For purposes of this foreclosure sale: (a) the current owner of the Property is Arthur L. Crisp; (b) the Subordinate
Lien Holders are: First Franklin Financial Corporation., a copy of this Notice was sent to the required parties.
    The Property shall be sold subject to: (a) the property taxes for 2015 and “Roll-back” taxes and special
assessments, if any; (b) all applicable covenants, conditions, restrictions, easements, building setback lines, zoning and health ordinances; ©) all matters shown on any Plat or plan of public record affecting the Property; and, (d) any other matter affecting the Property that a current title search and a current accurate Survey of the Property might disclose.
    Notice of Delinquency and of right to foreclose was mailed to Arthur L. Crisp. The Property is being sold “As Is, Where Is, With All Faults,” and neither the Lender nor the Substitute Trustee make any express or implied warranties of merchantability or fitness for a particular purpose. Substitute Trustee shall sell and convey said Property only as Substitute Trustee and not otherwise. The proceeds of the sale will be applied to costs of
the sale and the indebtedness as set out in the Deed of Trust The highest bidder at the foreclosure sale will be required to close or settle on the purchase of the Property by certified funds within 24 hours from the advertised hour of sale, unless extended by the Substitute Trustee. Should the highest bidder fail to comply with the terms of the bid at the foreclosure sale, then the Substitute Trustee shall have the option of accepting the next highest bids in descending order.
    The Substitute Trustee reserves the right to postpone or adjourn the foreclosure sale to another date, time or place,
without further publication, upon announcement at the aforesaid place and date, or any subsequent dates or places, to which the foreclosure sale is postponed or adjourned; and, this foreclosure sale is subject to confirmation by the Lender and may be rescinded at any time.
THIS NOTICE OF SUBSTITUTE TRUSTEE’S FORECLOSURE SALE IS AN ATTEMPT TO COLLECT A
DEBT BY THE NOTE HOLDER, SUBSTITUTE TRUSTEE, AND THE LAWYERS AND LAW FIRM SET FORTH
HEREIN AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
