NOTICE OF FORECLOSURE SALE

WHEREAS, on August 19, 2004, Chester Rall and Susan L. Rall executed a Deed of Trust (ATrust Deed@) in favor of Larry A. Butler, Trustee, to secure an indebtedness described therein, the same being payable to BancorpSouth Bank with said Trust Deed being of record in the Register=s Office of Hardeman County, Tennessee in Trust Deed Book 612 Page 518, to which reference is hereby made; and
WHEREAS, the said Larry A. Butler, Trustee, is unable to act as Trustee under the Deed of Trust, and I, Jerry P. Spore have been appointed Substitute Trustee (the “Trustee” or  “Substitute Trustee” by the owner and holder of the Note by an instrument of record in Trust Deed Book 725, Page 436, Register’s Office for  Hardeman County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW THEREFORE, notice is hereby given that I, Jerry P. Spore, Trustee, pursuant to the power, duty and authority vested in and conferred upon me, by the Deed of Trust, will on Wednesday, March 18, 2015, at 11:00 a.m., at the front door of the Hardeman County Courthouse on Court Square in  Bolivar, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Hardeman County, Tennessee, described as follows:

BEGINNING at a cotton picker spindle in the center of Hardeman Street, being the SW corner of the Church of Christ property (G-7/346), runs thence with the SBL of same S. 89 degrees 20 min. 01 sec. E 206.31 ft. to a set iron fence post, being an exterior corner of the residue of the Bobby and Lucille Shelby property, thence with a WBL of said residue South 151.6 ft. to a set cotton picker spindle in the north margin of the Southern Railroad ROW in Charleston Ave., being the SW corner of said residue; thence with the north margin of said railroad property with said Charleston Ave. West 206.3 ft. to a cotton picker in the center of Hardeman Street, thence with the center of said street North 154 ft. to the point of beginning, containing 0.724 acres more or less.
Per Certificate of Survey of L. Wayne Yates, R.LO.S. No. 486, 711 West McNeal Street, Bolivar, dated September 14, 2000.
Being the same property conveyed to Chester E. Rall and wife, Susan L. Rall by Warranty Deed of record in Deed Book F17, Page 246, in the Register’s Office of Hardeman County, Tennessee.
The Street address of the above described property is 249 Hardeman Street, Grand Junction, Tennessee 38039-4233.
All right and equity of redemption, statutory and otherwise, homestead and dower, are expressly waived in the said Deed of Trust, and title is believed to be good, but the Trustee will sell and convey only as Trustee.
The property shall be sold AS IS, WHERE IS AND WITH ALL FAULTS and without any representations or warranties of any kind whatsoever, whether express or implied
The sale of the property shall be made subject to any and all prior liens, encumbrances, deeds of trust, easements, restrictions, building lines, unpaid taxes and assessments (plus penalty and interest, if any), plus any and all other matters and encumbrances superior in right to the lien of the Deed of Trust.  Further, such sale is also subject to any matter that on site inspection or accurate survey of the property might disclose.
The right is reserved to adjourn the day of sale to another day certain without further publication, upon announcement at the time set forth above.
