Sale at public auction will be on April 4, 2023 on or about 1:00PM local time, at the main door of the Hardeman County Courthouse, Bolivar, TN 38008, conducted by the Substitute Trustee as identified and set forth herein below, pursuant to Deed of Trust executed by HESTER A. CARDENAS AND PAZ J. CARDENAS, to FNC Title Services, LLC, Trustee, on July 20, 2015, at Record Book 729, Page 666-682 as Instrument No. 161693 in the real property records of Hardeman County Register’s Office, Tennessee.

Owner of Debt: Carrington Mortgage Services, LLC

The following real estate located in Hardeman County, Tennessee, will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:

Per the survey dated September 21, 2006 by Jack A. McAdoo, Jr., RLS # 1701, and being Lot 1, part of Emily Hammons, in Correction Plat of record in Plat Book B, page 692, in the Register`s Office of Hardeman County, Tennessee, more particularly described as follows:

Beginning at a new capped 1/2 iron rod, (typical of all irons in this description referred to as new), said new iron rod being S 85 degrees 11 minutes 10 seconds East and a distance of 29.06 feet from an old cotton picker spindle in the apparent center line of Van Buren Road, said cotton picker spindle being a southwest corner of the Emily Hammons parcel (Bk. 22 Pg. 390) and a northwest corner of the Billy Hammons parcel (Bk H16 Pg 391); thence coincident with East margin of Van Buren Road the following three (3) courses: (1) North 35 degrees 28 minutes 14 seconds East 118.80 to a new iron rod; (2) North 28 degrees 05 minutes 02 seconds East 99.63 feet to a new iron rod; (3) North 18 degrees 08 minutes 48 seconds East 81.12 feet to a new iron rod; thence along new severance lines of the Emily Hammons parcel the following two (2) courses: (1) South 74 degrees 09 minutes 42 seconds East - 151.60 feet to a new iron rod; (2) South 20 degrees 08 minutes 10 seconds West - 252.63 feet to a new iron rod; thence North 85 degrees 11 minutes 10 seconds West coincident with a north line of the said Billy Hammons parcel and generally along a fence a distance of 200.68 feet to the point of beginning, containing 43,560 square feet or 1.000 acres.

Being the same property conveyed to Hester Ann Cardenas by Quit Claim Deed from Emily Hammons, Gene Hammons, M. Elane Haino and Ben Haino, dated January 31, 2007 and recorded March 6, 2007 at Book 30, page 454.

Being the same property conveyed to Emily Hammons by Quit Claim Deed from Elizabeth McCommon, Hazel Aldrich and Bill Avent, dated February 6, 2006 and recorded February 22, 2006 at Book 22, page 390.

Being the same property conveyed to Elizabeth McCommon, Emily Hammons, Hester Cardenas, Elane Haino, Hazel Aldrich and Bill Avent by Quit Claim Deed from Georgia Philip, John B. Philip, Samuel Ricky Avent and Donna Marie Avent, dated February 10, 2006 and recorded February 17, 2006 at Book 22, page 304.

Being the same property conveyed to Phenton Avent by Deed from L.E. Hammons, dated January 10, 1948 and recorded January 10, 1948 at Book 24, page E.

The street address of the above described property is believed to be 1915 Van Buren Road, Bolivar, TN 38008, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control.

THE RIGHT IS RESERVED TO ADJOURN THE DAY OF THE SALE TO ANOTHER DAY, TIME AND PLACE CERTAIN WITHOUT FURTHER PUBLICATION, UPON ANNOUNCEMENT AT THE TIME AND PLACE FOR THE SALE SET FORTH ABOVE. THE TERMS OF SALE ARE CASH. If applicable, the notice requirements of T.C.A. 35-5-101 have been met.

All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, but the undersigned will sell and convey only as Substitute Trustee.

If the U.S. Department of Treasury/IRS, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor or Workforce Development are listed as Interested Parties in the advertisement, then the Notice of this foreclosure is being given to them and the Sale will be subject to the applicable governmental entities’ right to redeem the property as required by 26 U.S.C. 7425 and T.C.A. §67-1-1433.

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the purchase price.  The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
