NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF REAL ESTATE
    Default having been made in the payment of the debts and obligations secured by a certain Deed of Trust securing a promissory note, said Deed of Trust being executed on the March 25, 2004, by Rowland B. Hoff,  to Keith Foote, as same appears of record in the Register’s Office of Hardeman  County, Tennessee, in Trust Deed Book 605, Page 22, filed of record on March 26, 2004 at 1:15 p.m., to secure an indebtedness to First South Bank, in the amount the amount of $117,064.10; and
    WHEREAS, Donald D. Glenn of Madison County, Tennessee was substituted in the place and stead of Keith Foote, as Substitute Trustee  by instrument of record in Trust Deed Book 729  page 393, in the Register’s Office of Hardeman County, Tennessee as recorded on August 5, 2015 at 2:30 p.m.; and
    WHEREAS the holder of the note, First South Bank, which is the owner of the debt secured having declared the total indebtedness due, pursuant to said promissory note and trust deed at the option of the same, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust;
    NOW, THEREFORE, by virtue of the authority in me vested as substitute trustee under said instrument, this is to give notice that I will, on September 4 at 11:00 a.m., proceed to offer for sale and sell at public outcry at the west door of the Hardeman County Courthouse in Bolivar, Hardeman County, Tennessee and to the highest and best bidder for cash, the following described property, to wit:
Map 165E, Group E, Parcel 5.00
TRACT I:
    Beginning at the southeast corner of the Edd Snellings home lot, in the west boundary of Tippah Street in the Town of Grand Junction; runs thence West 320.2 feet to a fence corner post; thence South 52 feet to a fence corner post; thence North 87.5 degrees West 141 feet to a ditch; thence with the ditch South 8.5 degrees West 109 feet; thence South 12.5 degrees West 106 feet; South 22 degrees East 60 feet; South 13 degrees East 76 feet; South 39 degrees East 228 feet to a northwest corner of small lot bought by Snellings from the State of Tennessee; thence East 123 feet with same to a stake, northeast corner of said lot; thence North 112 feet to a red oak; thence South 85 degrees East 222 feet to a stake on the west margin of Tippah Street; thence North with west margin of same 105 feet to the southeast corner of Jack Watson; thence West 341 feet to the southwest corner of Jack Watson; thence North with same 200 feet to a northwest corner of Jack Watson; thence East 99 feet to the southwest corner of Wilson Dunn’s lot on which stands his house; thence North 131 feet to the northwest corner of said lot; thence East 210 feet to the west margin of Tippah Street; thence North 13 feet to the point of beginning, containing 2.7 acres.
TRACT II:
    Also a small lot at the south end of the original lot, being bounded on the west by a ditch; on the south by Frank Gibson; on the east by property belonging to several negroes; and the above tract on the north,
TRACT III:
    Beginning at an iron stake on C.B. McAlister’s northeast corner and west of road and ran with McAlister’s north boundary South 87 degrees West 231 feet to an iron stake in McAlister’s north boundary; thence with J.E. Snellings east boundary and with a fence North .5 degrees East 129 feet to an iron stake in a fence on the south side of J.E. Snellings driveway from Tippah Street; thence with the drive and a hedge North 87 degrees East 236 feet to an iron stake in a fence on the west side of road; thence with road or street South 3 degrees West 129 feet to the beginning, containing less than 3/4 acre.
    BEING the same property conveyed to Rowland B. Hoff  by Warranty Deed of record in Deed Book 60 at page 631 in the Register’s Office of Madison County, Tennessee.
    This property is commonly known as 543 Tippah Street South, Grand Junction TN  however such address is not a part of the legal description and in the event of any conflict the legal description shall control.

    Beginning at an iron pin in the west margin of Virginia Street in the south margin of Mississippi Row (undeveloped) this point of beginning being 100.0 feet south of the centerline of the Southern Railroad tracts, and 1258.2 feet west of the intersection of the south rail of the Southern Railroad and the west rail of the Illinois Central Railroad, this point also being the northeast corner of lot 29 in the Town of Grand Junction, from said point South 275.0 feet to an iron pin the north margin of Madison Street; thence West 510.6 feet to a point in a sidewalk; thence with the east margin of Walnut Street (undeveloped) North 275 feet to an iron pin; thence east with Mississippi Row 510.6 feet to the beginning, containing 3.22 acres.
    Located on this land is a two story old school building containing 10,800 square feet and a gym containing 6,048 square feet which were erected in 1915. There is also a one story addition east and west wings built around 1934 containing 7,870 square feet. There is a second building called the cafeteria built in 1965 which contains 5,241 square feet.
    The above described tract is bounded on an four sides by public street; the public street on North (Mississippi undeveloped) is un-opened; there is also a railroad easement across said un-opened Mississippi Street which was granted to Wedco, Inc. by the Town of Grand Junction in 1976.
    Being the same property conveyed to Rowland B. Hoff by virtue of a quit claim deed recorded in Deed Book 7, Page 504, in the Register’s Office of Hardeman County, Tennessee. And also by quit claim deed recorded in Deed Book I17 Page 273 in said Register’s Office.
    This property is commonly known as 1 Madison Avenue, Grand Junction TN  however such address is not a part of the legal description and in the event of any conflict the legal description shall control.
 THE TRUST DEED FORECLOSED UPON ENCUMBERS MULTIPLE PARCELS OF IMPORVED REAL PROPERTY.  THE TRUSTEE RESERVES THE RIGHT TO CONTINUE THE SALE OF ONE OR MORE OF THE PARCELS OF PROPERTY AS PROVIDED BY TENNESSEE LAW.
  All right of redemption, statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed good, but the undersigned, Substitute Trustee, will sell and convey only as Substitute Trustee, subject to any prior deeds of trust, real estate taxes, assessments, covenants, easements, restrictions and liens.
    Pursuant to T.C.A. § 35-5-104, the following liens or claimed liens of the United States or the State of Tennessee are of record in said Register’s office: None of Record.  If necessary, notice of the Substitute Trustee’s foreclosure sale has been given to the Internal Revenue Service or the State of Tennessee as provided for in U.S.C. § 7425(b) and/or T.C.A. § 67-1-1433(b)(1) h.  If applicable, the sale of this property is subject to any applicable redemption rights held by the United States Internal Revenue Service, as set out in 26 U.S.C. § 7425(d)(1) or the State of Tennessee, as set out in T.C.A. § 67-1-1433(c)(1).
 Other interested parties whose interest may be extinguished by this foreclosure are as follows: Hardeman County, the Hardeman County Trustee, City of Grand Junction and the Hardeman County Clerk and Master.  
    For informational purposes: it is believed that some Hardeman County and City of  Grand Junction taxes are due for 2014.    The Successor Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale.  If the highest bidder cannot pay the bid in full upon such terms as are announced at the sale, the next highest bidder, at their highest bid, will be deemed the successful bidder. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.  

A copy of this notice is being sent to the debtor pursuant to T.C.A. §35-5-101.

 The Trustee caused the records check to be done to insure that the borrowers are not subject to the Service-Members Civil Relief Act.
