NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated February 1, 2013, executed by JOSE NUNEZ D/B/A NUNEZ REMODELING AND REPAIR conveying certain real property therein described to Chicago Title Insurance Company, as Trustee, as same appears of record in the Register’s Office of Fayette County, Tennessee recorded February 6, 2013 at Instrument Number 13000800 and in the Register’s Office of Hardeman County, Tennessee recorded February 8, 2013 at Deed of Trust Book 708, Page 79; and

WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to Lambert Law Group PLLC who is now the owner of said debt pursuant to the Corporate Assignment of Deed of Trust appearing of record in the Register’s Office of Fayette County, Tennessee recorded August 29, 2022 at Instrument Number 22006866 and in the Register’s Office of Hardeman County, Tennessee recorded January 11, 2023 at Deed of Trust Book 807, Page 450; and

WHEREAS, the undersigned Johnson Law Group PLLC having been appointed as Substitute Trustee by the Appointment of Substitute Trustee appearing of record in the Register’s Office of Fayette County, Tennessee recorded January 30, 2023 at Instrument Number 23000626 and in the Register’s Office of Hardeman County, Tennessee recorded January 30, 2023 at Deed of Trust Book 807, Page 873;

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Johnson Law Group PLLC, as duly appointed Substitute Trustee or its duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee will, on March 22, 2023 at the place where foreclosure sales customarily occur at the Fayette County Courthouse, Somerville, Tennessee at 11:00 a.m. and on March 22, 2023 at the place where foreclosure sales customarily occur at the Hardeman County Courthouse, Bolivar, Tennessee at 1:00 p.m., proceed to sell at public outcry to the highest and best bidder for cash or certified funds ONLY, the following described property situated in Fayette County, Tennessee and Hardeman County, Tennessee:

All property set forth in the legal description(s) listed in or exhibited to the Deed of Trust appearing of record in the Register’s Office of Fayette County, Tennessee recorded February 6, 2013 at Instrument Number 13000800 and in the Register’s Office of Hardeman County, Tennessee recorded February 8, 2013 at Deed of Trust Book 708, Page 79;

The Fayette County Parcel IDs are: 068 032.00, 090EA028.00, 090KA005.00, 075 019.01, 169 082.00, and 169GG009.00;

The Hardeman County Parcel IDs are: 070PH013.00, 090 022.00, 165EC002.00, and 027 009.02;

The Fayette County property addresses are believed to be: 801 and 803 Charleston Street, Somerville, Tennessee 38068; 101, 102, 103, 104, and 105 Minor Drive, Somerville, Tennessee 38068; 225 Day Road, Somerville, Tennessee 38068; 190 Locke Road, Somerville, Tennessee 38068; 75 Jefferson Drive, Somerville, Tennessee 38068; 125 Pinetree Road, Moscow, Tennessee 38057; and 75 Somerville Street, Somerville, Tennessee 38068;

The Hardeman County property addresses are believed to be: 100 Chandler Lane, Whiteville, Tennessee 38075; 316 Hardeman Street, Grand Junction, Tennessee 38039; 304 North Union Street, Bolivar, Tennessee 38008; and 125 Fish Lane, Bolivar, Tennessee 38008;   

In the event of any discrepancy between the street addresses and the legal description of the property set forth in the referenced Deed of Trust, the legal description shall control.

The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. This property is being sold with the express reservation that it is subject to confirmation by the lender or Substitute Trustee. This sale may be rescinded at any time. The right is reserved to adjourn the day of the sale to another day, time, and place for the sale set forth above. All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The Property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular use or purpose.
