Substitute Trustee’s Notice of Sale of Real Estate

    Default having been made in the payment of the debts and obligations secured to be paid in a certain Deed of Trust, executed the 16th day of December, 2008, by Tony Ross and Summer Ross, to H. McCall Wilson, Jr., as Trustee as the same appears of record in the Office of the Register of Hardeman County, Tennessee, at Deed of Trust Book 674, Page 684.  Thomas M. Minor was thereafter appointed Substitute Trustee of record at Deed of Trust Book 713, Page 14 in the said Register’s Office of Hardeman County, Tennessee.
    Whereas, The Bank of Fayette County, being the owners of the debt secured by said Deed of Trust, having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of said indebtedness having matured by a default in the payment of the debt and obligations secured, at the option of the Owner, after being authorized to proceed with a sale under the aforesaid Deed of Trust in the event of a default there under, this is to give notice that the undersigned will on the 20th day of February, 2015, commencing at 11:30 a.m., at the front door of the Courthouse in Bolivar, Hardeman County, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in the 1st Civil District of Hardeman County, Tennessee, to wit:

Beginning at a point in State Route 125 (Silerton Road) Bearing South 85 degrees 47 minutes 43 seconds West 188.79 feet from a point in said road in line with a fence running southeasterly along the east boundary line of Ross (Tract No. 1 Deed Book X-3, Page 263), said beginning point bears South 2 degrees 53 minutes 41 seconds West 25.15 feet from an iron rod set as a witness, thence along the center of said road, South 86 degrees 37 minutes 59 seconds West 156.97 feet; thence leaving said road along a severance line and residue of Ross the following 4 calls: 1) North 3 degrees 40 minutes 15 seconds East, passing an iron rod set at 25.19 feet and on for a total of 301.61 feet to an iron rod set; 2) North 74 degrees 53 minutes 25 seconds East 43.87 feet to an iron rod set; 3) South 70 degrees 2 minutes 41 seconds East 115.59 feet to an iron rod set; 4) South 2 degrees 53 minutes 41 seconds West 264.20 feet to the point of beginning containing 1.03 acres more or less.  Also, see plat of record in Plat Book B, Page 414, Register’s Office of Hardeman County, Tennessee.
    Together with and subject to any covenants, easements, or restrictions and all right of way rights to Highway 125.
This being the same property which has been designated by the Hardeman County Tax Assessor as Parcel No. 22.01, on Tax Map 58.
    This being the same property conveyed to Tony Ross and wife, Summer Ross by Warranty Deed of record at Deed Book 18, Page 768 in the Register’s Office of Hardeman County, Tennessee.

    The sale of the above described property shall be subject to unpaid property taxes, assessments, subdivision restrictions, building lines, easements and all other prior liens and encumbrances of record superior in right to the Deed of Trust.  Specifically that First Mortgage Deed of Trust dated August 30, 2005, in favor of First Franklin, a division of Nat. City Bank of IN, in the original principal amount of $65,000.00 of record at Deed of Trust Book 630, Page 607 in the Register’s Office of Hardeman County, Tennessee, which was thereafter assigned to First Franklin Financial Corporation by Transfer and Assignment dated January 5, 2006, being of record at Deed of Trust Book 637, Page 418 in said Register’s Office; and further was assigned to Deutsche Bank National Trust Company as Trustee for the Holders of the First Franklin Mortgage Loan Trust 2005-FF11, Mortgage pass through Certificates, Series 2005-FF11, by Transfer and Assignment dated September 21, 2005, of record at Deed of Trust Book 717, Page 801 in the Register’s Office of Hardeman County, Tennessee.  In Addition, the following parties may claim an interest in the above referenced property: 1.) First Mortgage Holder, Deutsche Bank National Trust Company, 300 South Grand Avenue 41st Floor, Los Angeles, CA 90071; 2.) Tennessee Housing Development Agency, Attn: Single Family Programs Division, 502 Deaderick Street, Third Floor, Nashville, TN 37243.
    All rights and equities of redemption, statutory right of redemption, homestead and dower and all other rights or exemptions of every kind are expressly waived and title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.  The sale held pursuant to this notice may be rescinded at the Substitute Trustee’s option at any time.  The right is reserved to adjourn the day of the sale to another day certain without further publication, upon announcement of the time and place for the sale set forth herein.
