NOTICE OF ISSUANCE OF AN EMERGENCY TREATMENT PERMIT TO Chemring Group PLC

The Tennessee Department of Environment and Conservation (TDEC) Division of Solid Waste Management (DSWM) has issued an emergency treatment permit to Chemring Group PLC. Their facility, known as Kilgore Flares Testing Facility (EPA ID TNR000035113), is located in Hardeman County at 1450 Keller Road, Toone, TN 38381. The permit (TNTMP-16-001) allows 296 antiquated blasting caps to be safely detonated onsite rather than shipped to an offsite treatment facility. The blasting caps are classed as DOT 1.4 explosive and have a D003 (reactive) hazardous waste code. The permit is valid for 90 days beginning July 26, 2016 and shall terminate on October 24, 2016.
Issuing an emergency permit under Tennessee Rule 0400-12-01-.07(1)(d) was necessary because these blasting caps are past the useful shelf life and need to be disposed. Proper documentation that would ensure this material could be legally and safely transported over the public roadways cannot be located. Additionally, the chemical stability of explosives changes with age, dependent on the storage environment and formulation of the explosive. Therefore the material must be disposed on site. The permit was issued under the authority of the Tennessee Hazardous Waste Management Act of 1977, as amended, Tennessee Code Annotated, Section 68-212-101 et seq., and Tennessee Rule Chapter 0400-12-01, Hazardous Waste Management.
