NOTICE OF FORECLOSURE SALE

WHEREAS, CARTER TIMBER & LAND, INC. and TIM HARRIS executed a Deed of Trust (the “Deed of Trust”) dated July 30, 2012, of record in Trust Deed Book 703, Page 691, Register’s Office for Hardeman County, Tennessee, and of record in Record Book 148, Page 244, Register’s Office for Wayne County, Tennessee, which Deed of Trust conveyed to J. Gilbert Parrish, Jr., Trustee (the “Trustee”), the hereinafter described real property to secure the payment and performance of indebtedness and obligations to WAYNE COUNTY BANK, as fully described in the Deed of Trust; and
    WHEREAS, CARTER TIMBER & LAND, INC. conveyed its undivided three-fourths (3/4) interest in the hereinafter described real property to LAKE VONDA RESORT, LLC by quitclaim deed of record at Deed Book 63, Page 413, Register’s Office for Hardeman County, Tennessee, subject to the Deed of Trust, with a Scrivener’s Error Affidavit of record at Deed Book 69, Page 324, Register’s Office for Hardeman County, Tennessee; and
    WHEREAS, TIM HARRIS conveyed its undivided one-fourth (1/4) interest in the hereinafter described real property to LAKE VONDA RESORT, LLC by quitclaim deed of record at Deed Book 66, Page 383, Register’s Office for Hardeman County, Tennessee, subject to the Deed of Trust; and
    WHEREAS, default has been made in the payment and performance of indebtedness and obligations secured by the Deed of Trust; and
    WHEREAS, pursuant to Appointment of Successor Trustee of record at Deed of Trust Book 728, Page 271, Register’s Office for Hardeman County, Tennessee, and of record at Record Book 174, Page 765, Register’s Office for Wayne County, Tennessee, the owner and holder of the secured indebtedness appointed the undersigned, Linda W. Knight, as Successor Trustee, and the owner and holder has instructed the Successor Trustee to advertise and sell the property as set forth in the Deed of Trust.

    RETAINED ACCESS EASEMENT:
The property conveyed herein is sold subject to the west half of a sixty foot road and utility easement centered on the east boundary of the above tract and Lake Vonda Drive and the north half of Mt. Olive Church Road on the boundary of the above tract.
    CONVEYED ACCESS EASEMENT:
Further conveyed herein is a non-exclusive ingress and egress easement to cross the Eastern half of Lake Vonda Drive and Mt. Olive Church Road and use such other existing roads crossing the grantors property as are necessary to gain ingress and egress to the property conveyed herein.  Said easement shall be perpetual and a real covenant running with the land for the benefit of the grantee and its successors and assigns.
    TIMBER HARVESTING COVENANT:
The grantors and grantee covenant and agree that no timber harvested shall be removed across any paved road and only gravel roads to the south shall be used to remove timber.
    All distances are based on a field run survey using electronic distance measuring equipment and have been adjusted for temperature.  Survey done by D. P. Surveying, dated March 30, 2012 by David H. Parsons, T.R.L.S. # 1693.
